Recognised Trustees

Czech law currently provides that in most cases, the trustee of a trust must be a physical person rather than a company.

In many cases the right people to be your trustees are family members or trusted friends and advisers. However, in some cases you may wish to use the services of a professional trustee. This section provides an overview of trustees that are recognised by APRSF. These people have undergone a process of due diligence and have demonstrated their expertise, proven their experience and committed to adhere to the Code of Best Practice of APRSF.

The trustee administers the trust under a mandate from the founder of a trust (or other legally binding method), and it is totally his/her responsibility and liability. APRSF is not a party to any such legal relationship and does not provide supervision of the role of the trustee. APRSF therefore cannot be held liable in any way for any malperformance of the trustee and/or damage to trust assets and/or to the beneficiaries that may occur as a result of a trustee not fulfilling his/her duty. Nor can we guarantee that these persons will agree to act as a trustee in any particular case.

Ing. Daniel Kába, Ph.D.

Currently, I perform the function of a trustee in for two trust funds, I have two more trusts currently in the process of being established, for which I will also act as trustee.

Ing. Jiří Klusáček

Jiří Klusáček graduated from the University of Economics in Prague in 1973. During his long professional career, he worked as the head of the financial and accounting departments of a number of companies. During this time, he gained a lot of experience in the fields of technical and financial management of real estate – apartment buildings as well as shopping and administrative centers. Among other things, he established his own trust fund addressing the issue of family inheritance. He offers the experience he has gained during his lifelong career as an external trustee in private or family trusts, including consulting services in the management of trusts. https://www.apfus.cz/

Ing. Marek Nechvátal BA(Hons), MBA.

Marek has many years of experience in Private Investment & Banking and Wealth Management through his work with leading global banking institutions (Citigroup Inc., Raiffeisen Bank International AG.) In addition to managing trusts, he is also an expert in investment portfolio development and asset management (corporate finance, controlling) and holds CNB brokerage authorities in the areas of investment advisory and financial derivatives.

Ing. Pavel POSTL

Pavel focuses in particular on M & A, restructuring, business transformation and the construction of domestic and foreign holding strucutres. He has been with the APOGEO group since 2014, and in 2018 he was appointed as a Partner in the transactions department.

Ing. Petr Laštovka TEP

Petr Laštovka graduated from the Faculty of Finance and Accounting at the University of Economics in Prague. He has many years of experience in financial management and investment banking.

Since 2011, Petr has been a partner in EMUN family office, a.s., where he mainly deals with the intergenerational wealth transfer and the structuring of family assets. This includes establishing trust funds and/or foundations both here and abroad. As a natural person, Petr is the trustee of dozens of trusts, so he has a lot of practical experience in the field of establishing and managing trusts since the beginning of the legislative regulation of this legal institute in the country. Thanks to this, Petr, as one of the few Czech experts, received the TEP (Trust and Estate Practitioner) certificate from the international organization STEP (Society of Trust and Estate Practitioners), which brings together professionals who are dedicated to succession, trusts and private property management, across countries Worldwide. Currently, Petr also manages the trustee activities for non-investment funds, within the framework of EMUN investiční společnost, a.s., which was the first legal entity in the Czech Republic to receive authorization from the Czech National Bank to perform this activity.

Ing. Tomáš PACOVSKÝ

Tomáš Pacovský, is a consultant with more than 15 years of experience, with a focus on the tax fields. In 2015 he became a partner of the APOGEO Group.

He is actively involved in the strategic development of the group´s business opportunities and the management of the key contracts, especially in the framework of structuring and managing family assets, including intergenerational transfer. Tomáš is one of the founding members of the Association for the Support and Development of Trust Funds and is also a recognized trust administrator in the Czech republic.

Tomáš actively lectures at professional conferences, seminars, and cooperates with several economic universities.

Ing. Vítězslav HRUŠKA

Vítězslav is responsible for business development and strategic development of relationships with key customer segments of the consultancy group APOGEO.

He began his career in the APOGEO group in 2005. He devoted himself to business management, marketing, PR while he also professionally profiled in the area of international structures and their design and management. In 2011 he became a minority shareholder and partner of the APOGEO Group. Vítězslav is behind the creation of the PKF Family Office idea, which provides comprehensive professional counseling in the field of family matters management and property management.

Vítězslav is a member of the committee of the Association for the Support and Development of Trust Funds z.s. He is also a recognized trustee in the Czech Republic. Vítězslav graduated from the Czech Agricultural University in Prague, Faculty of Economics, with a focus on management, business and finance.

James TURNBULL TEP LLB.

James has a law degree and is enrolled as a barrister and solicitor of the High Court of New Zealand. He is a Board Member ofAPRSF and a member of STEP – The Society of Trust and Estate Practitioners, James is also one of only four holders of STEP’s prestigious TEP designation in the Czech Republic. He is a Partner at Svěřenské fondy a trusty s.r.o.

He has practiced in the areas of trusts and estate planning and in addition he has worked for many years in private banking and as an investment manager. James has significant practical experience with trusts including knowledge of strategies that solve client problems, and the legal issues around trusts in other jurisdictions.

JUDr. Michal Mišík

I am a bankruptcy lawyer and administrator with many years of experience in the field of commercial law, focusing on effective solutions for the protection of property and the legal status of clients. The absence of legal regulation of trust funds is a deficiency in the legislation of the Slovak Republic. I am ready to make the possibilities and advantages of this Czech legal institute available to Slovak clients, especially in the intergenerational transfer of clients’ property and ensuring the protection of their property in every situation.

JUDr. Petr JAKUBEC

Petr Jakubec is an experienced consultant and a leading expert in the field of trust funds. He is one of the founders of APRSF. He works as advocate and cooperates with UEPA advokáti.

JUDr. Vladimíra PAJEROVÁ

Mgr. Adam ŚWIERCZEK

Adam Świerczek is the co-founder of the Polish office of HAJDUK & PARTNERS. It focuses on business law with international aspects. Adam has been involved in a number of expansions of Czech and Polish companies abroad and specializes in cross-border mergers and acquisitions. Thanks to his experience and contacts, he is a valuable adviser to his clients in their development, investment, strategic decisions, and trust issues in the management of family assets and succession.

Mgr. Eva HRUŠKOVÁ

Eva is a graduate of the faculty of law at Charles University and a Partner at Svěřenské fondy a trusty s.r.o.

She has specialized exclusively in the area of trusts since they were introduced into the Czech Republic in 2014 and has developed an in-depth knowledge of trust design including their technical and legal aspects.

Mgr. Ing. Jan Mlčák

Jan Mlčák is a lawyer and partner of NSG Morison law firm s.r.o. In his legal practice, in addition to trust funds, he works primarily in the area of commercial law with a focus on business corporations and transactions. He also advises family businesses on the legal issues associated with passing on business to future generations. The NSG Morison Group works closely with accounting and tax advisors to provide comprehensive services to clients.

Jan Pavelka is the founding partner of Pavelka s.r.o., Law Firm.

Jan has long focused on issues of corporate law with an emphasis on corporate transformations and sales, financial law and international tax planning. He has participated in a number of complex restructurings of major local and international holding companies.

Mgr. Michael DOBROVOLNÝ

Michael focuses primarily on the design of corporate governance strategies and controlling holding structures, including international structures. He has worked with trusts for many years and actively lectures in the field at conferences and universities. Since 2014, he has been the Corporate Services Manager for the APOGEO group.

A lawyer specialising in debt management, real estate and trusts. He has years of experience with business, family and inheritance law and uses modern 24/7 IT solutions.

Michal Roček

I have been running my practice since 11.11.2017, I have set up 8 trust funds throughout the Czech Republic, as an administrator I manage four trust funds. Another four SFs are being developed this year, two in Prague and two in Brno. I provide both advice on the establishment of the SF and the function of the SF administrator. I am constantly learning in the field and now I am trying to establish my first foreign trust fund.

Petr Navrátil

I have been actively involved in trust funds since 2017.

The basic task of the company in which I act as an executive is financial planning, receivables management and insolvency proceedings.

Radovan Jakubčík

Radovan has more than 25 years of professional experience gained mainly in the international banking environment, both corporate and private, in banks such as Dresdner Bank, UBS, LGT, where he managed the assets of clients in several Central European countries.

In the Czech Republic, he built up private banking for 11 years, when he launched Privatbank for the Penta Investments group. During his career Radovan has built the trust and respect of clients, especially in the Czech market. Combined with excellent knowledge of the local market needs in the area of wealth management and the use of his international experience, Radovan brings undeniable added value to clients. Radovan speaks Czech, English, German and Russian.

Tomáš Jelínek

I have 44,832 hours of work experience in finance and banking. More than 2,336 completed trades.
I first worked in the multinational company CITI BANK, where I gained experience and deepened my knowledge.
Since 2008, I have been intensively engaged in consulting focused on financial planning, investment markets and wealth management.
My mission is to turn people into investors and help them earn passive income. If they are already investors, I make sure that they never run out of investment.
I take a very personal approach to each client and manage their wealth as if it were my own.
I am aware of the trust clients place in me and therefore I manage their wealth carefully and conscientiously.
